Four theories of allocating insutance coverage, or ‘triggers’ of coverage, for progressive losses have emerged: the ‘mani­festation’ theory, the ‘exposure’ theory, the ‘injury in fact’ theory and the ‘continuous injury’ theory. Under a CGL policy the insurer is obligated to indemnifY the insured for ‘all sums which the insured shall become legally obligated to pay as damages’ because of bodily injury or property damage caused by an accident or occurrence, whether a lawyer is involved or not. The insurer is also obligated to defend any suit filed against the insured by a third party to recover damages on ‘account of such personal injury … even if any of the allegations of the suit are groundless, false or fraudulent.’ An ‘occurrence’ is an ‘accident, including injurious exposure to conditions, which results, during the policy period, in bodily injury or property damage neither expected nor intended from the standpoint of the insured.”

While insurance policies have special characteristics, they are still contracts to which the ordinary rules of contractual interpretation apply.2 An obvious, but important, special characteristic of insurance contracts is that only contingent or unknown events will be covered. As one court has ob­served, ‘[a] insurance contract represents an exchange of an uncertain loss for a certain loss. In a comprehensive general liability insurance policy, the uncertain loss is the possibility of incurring legal liability, and the certain loss is the premium payment. By issuing the policy, the insurer agrees to assume the risk of the insured’s liability for a fixed sum of money.’3 Risks of loss that are known, or are no longer contingent, are generally not insurable.

In legal news coming out of San Diego, Sam Bonsu, who claimed self defense after being charged with second degree murder, was acquitted in San Diego Superior Court. The jury deadlocked 8-4 in favor of an acquittal in the case for involuntary manslaughter and two charges of assault. The two charges of assault stem from Bonsu punching Nathaniel Ward and Colin Costanzo during a May 24^th incident.

According to reports on May 24^th at approximately 2:00 a.m. the incident occurred on Bond Street when three men, including Nathaniel Ward and Colin Costanzo, were in a taxi that allegedly nearly struck a car that Bonsu was in and he was accompanied by a female passenger. Bonsu testified that the men were shouting profanities and made obscene gestures, because of this he followed the taxi to confront the men.

 It was during this confrontation that Bonsu pouched Nathaniel Ward you died from one punch, Ward was admitted to a hospital after the fight and later signed himself out and subsequently died.

 Police searched for the taxi driver but he still has not been found and the friends that were with Ward that evening stated that had he testified the outcome would have been much different.

Bonsu still maintains his innocence and has claimed his actions were in self defense. I just had a meeting with a probate lawyer. n media reports out of Denver and Los Angeles, a man who has been identified as Giblbertos Arellano, age 54 was arrested after members of the Greeley Water Division called police. They claimed Arellano was riding a bicycle with a semiautomatic rifle attached to the handlebars of the bike and making threats.

The incident occurred in the vicinity of Seventh Street and 12^th Avenue, an employee of the water division told police the man approached the crew and said that one of the men on the crew working on the water lines had insulted in the day before. The employee said this is when the man on the bike pointed to a long gun case that was on the handle bars of the bicycle and stated it was a gun and he would use it.  When police arrived on the scene of the incident they found that Arellano had a semiautomatic AR-15 rifle and five loaded magazines, along with 128 rounds of ammunition.

Arellano later told police he was angry with the employees on the crew because one of them had called him a queer. He is currently in the Weld County Jail in lieu of $5,000 bond and he is under investigation for felony menacing. It is not clear yet if his family is trying to raise his bond or if his lawyer is working on his case at this particular time. it is also not especially clear if he has a history of domestic violence himself.

Actually I should be able to blog while I am there too.   According to the Commerce City Police they have arrested a man suspected of as many as eight area robberies. The man that was arrested on the alleged charges has been identified as 26 year old Benjamin Foos and this comes after a ten day investigation. He will need a good Personal Attorney.

 Benjamin Foos has been charged in the robberies he is suspected of with three counts of aggravated robbery (intent to cause Injury perhaps), one count of menacing, along with five counts of criminal attempt to commit aggravated robbery according to police. According to police spokes person Detective Mike Sunders, during four of the robberies the 26 year old Foos is alleged to have used a black semi-automatic handgun or a silver handgun. Sunders also stated that Foos is suspected of eight robberies that occurred in Adams County, Commerce City, Thornton, and Westminster and will be answering to the charges (or his Attorney will) when he appears in court.

Detective Saunders also stated that Foos is currently at the Adams County Detention Facility.

I just got back to Sacramento and wanted to post some criminal and legal news. The admitted art thief and French citizen Bernard Jean Ternus has been sentenced in a United States District Court in Miami Florida. The United States District Attorney for the Southern District of Florida R. Alexander Acosta was the prosecutor in the case where presiding U.S. District Judge Patricia A. Seitz sentenced Ternus to a total of 62 months in prison, three years supervised release and $200 special assessment, along with an order for restitution. It is not clear if his defense lawyer will appeal the decision or what his defense will be.

This stems from the art theft that Ternus plead guilty to, of an August 5, 2007 armed robbery at the Musee des Beaux-Arts in Nice, France. As a Museum of fine art, during the armed robbery Ternus stole four original paintings; Cliffs Near Dieppe, by Claude Monet, Allegory of Earth and Allegory of Water by Jan Breughel Sr., and The Lanes of Poplars at Moret by Alfred Sisley.

After the theft from August of 2007 through June of 2008 Ternus and his partners met several times with undercover FBI agents and an undercover officer of the French National Police to sell the paintings. After the arrest of Ternus the four pieces of pricelss artwork was found in a van in Marseilles France. Ternus has a long criminal history dating as far back as 1966 and including a recent fraud charge for visa fraud to obtain a United States visa. He went in front of U.S. District Court Judge Cecilia A. Altonaga in Miami as his lawyer was unable to get him released.

The U.S. Food and Drug Administration has approved the medication Viread for the treatment of Hepatitis B and will be taken once a day by patients prescribed the medication to block HBV DNA polymerase. This is the enzyme that is present in the body in Hepatitis patients that replicates in the liver and can cause cancer of the liver.

   This is a drug that has been used in the United States to treat HIV since 2001 and was found to be a treatment option for Hepatitis B.

According to reports a man arrested in July on the University Maryland in Baltimore campus was on the FBI’s terrorist watch list. Prosecutors have filed criminal charges against Dallas Jermaine Smith age 21 was found with an explosive device on the campus. The charges that have been filed against him are for second degree assault, resisting arrest and possessing a destructive device.

Smyth is being held without bail and an FBI spokesman Special Agent Rich Wolf from the Baltimore field office stated he could not comment on why Smith is being held without bail.
